PolyCem LLC warrants to the original purchaser only that it will supply replacement tile for any defective tile (or is not manufactured pursuant to specifications) if the claim for warranty is presented to PolyCem LLC on or before the five (5) year period following the date of purchase.

Except as expressly provided above, PolyCem LLC makes no representation or warranty, expressed or implied, relating to the condition of PolyCem LLC’s products, including, without limitation, any implied or express warranty of merchantability, fitness for a particular purpose or conformity to models or samples of products, or any defect or errors in installation.

Exclusion of Remedies/Damages:
PolyCem LLC shall not be liable for incidental,consequential or indirect damages and PolyCem LLC’s sole liability shall be to replace goods as set forth above. Collection: If customer fails to pay any amounts owing to PolyCem LLC when due, customer agrees to pay interest on amounts due to PolyCem LLC at the lower of (i) 18% per year or (ii) the highest rate of interest permitted to be charged. Additionally, customer shall pay all of PolyCem LLC’s costs of collection, including reasonable attorney fees.
